Your Auto Insurance After a DUI

DUI Auto Insurance is a major concern for those convicted of drunk driving under the influence. In order to get your license back, or to obtain a restricted licence, you will be required to show a proof of DUI auto insurance.

Proof of insurance in the form of SR-22 must be maintained for a period of three years (from the date the original 4 month suspension would have been up). Proof of DUI auto insurance will stay active (and you need not re-submit an SR-22) if you do not cancel the policy or get dropped during the 3 year period. If for any reason your policy is no longer in effect the insurance company is REQUIRED to notify the DMV. The DMV will then notify you that by a certain date you will have to file another proof of DUI auto Insurance with them or your license will be suspended.

You have the right to request a hearing within 10 days of being arrested for DUI. If you can prove at the hearing that your DUI arrest was a mistake, the action will be set aside. If your BAC at arrest was close to .08, it makes sense to try to contest. There is a number of technicalities involved in DUI testing procedure that can be contested. Don’t just sit and wait — take action and fight for your rights!

DUI Breath Test Refusal Penalties

DUI law of every state but Nevada suspends a driver’s license for refusing a breath or blood test after being stopped on suspicion of drunk driving. With three new laws passed in 2005, 19 states now add civil or criminal penalties ranging from fines to jail time. Here are the penalties, plus the 2001 percentage of drivers who refused the tests in those states:

Alaska: Minimum $250 fine and 72 hours jail for first offense; increases to $4,000-$5,000 and one year for sixth. 17 percent.

Arkansas: Minimum $100 fine for first offense; increases to $500-$2,000 and 60 days community service for third. 21 percent.

Understanding DUI Penalties.

Here are some common DUI penalties for a first occurrence of drunk driving.

Most states will impose a large fine, somewhere around $1500. Usually it can be arranged to be paid in monthly installments. DUI First Offender School (12 weeks long). Three years probation (which is a probation in name only, as there is no probation officer). Ninety days license restriction (to be initiated after the four months DMV suspension runs out) Several days (typically 5 to 12) of community service program (cleaning buses, picking up trash, digging ditches etc.) Ninety days license restriction is in addition to the four months of DMV suspension. The suspension goes into effect thirty days after a DUI arrest.
